According to WHTM, with the implementation of the “Act No. 57 of 2025”, manufacturers of electronic cigarettes and vaping products in Pennsylvania now need to obtain certification from the Pennsylvania Attorney General’s Office before they can sell their products in the state.
Pennsylvania requires nicotine-containing e-cigarette manufacturers to complete certification
The Pennsylvania Attorney General’s Office announced that any manufacturer of nicotine-containing e-cigarettes sold or offered for retail sale within the state of Pennsylvania must obtain certification from the Attorney General.
This means that thousands of e-cigarette sellers in Pennsylvania will be able to purchase products only from certified manufacturers in the future.
The electronic cigarette catalogue will be released before June 20th.
The Office of the Attorney General stated that it will “maintain and make public a catalogue”, which will list all the nicotine-containing electronic cigarette manufacturers that have submitted and had their certification forms approved by the Attorney General, along with their brand names, product categories, product names and flavors.
This catalogue will be posted on the website of the Attorney General’s Office before June 20, 2026.
The Pennsylvania e-cigarette directory also requires that all e-cigarettes undergo certification, including any components that are required to submit a pre-market tobacco product application (PMTA) by the US Food and Drug Administration.
The Attorney General stated that the new law provides tools for seizure and recovery.
The Attorney General’s Office said that e-cigarette manufacturers and sellers can obtain forms, information and other materials online to comply with the “Act No. 57 of 2025”.
The Attorney General of Pennsylvania, Dave Sunday, stated that the legislative body has provided his office with various tools, including severe penalties, seizure of products not listed in the directory, and the power to recover costs from the offenders, in order to help prevent these products from being marketed in Pennsylvania.
