    Nicotine Pouches in England: What Does the Law Say?

    Nicotine pouches have become increasingly visible across the UK, offering adults a tobacco-free way to consume nicotine without smoking or vaping. Their growing popularity has also raised an important question: Are nicotine pouches legal in England, and what rules apply to their sale and use?

    The legal position has changed significantly in 2026. The Tobacco and Vapes Act 2026 received Royal Assent on April 29, 2026, introducing a new legal framework covering nicotine products, including nicotine pouches.

    Here’s what consumers and retailers need to know.

    What Are Nicotine Pouches?

    Nicotine pouches are small oral products that contain nicotine but do not contain tobacco leaf. They are normally placed between the lip and gum, allowing nicotine to be absorbed through the tissues of the mouth.

    The UK’s Committee on Toxicity (COT) has noted that nicotine pouches can deliver a pharmacologically active dose of nicotine and therefore should not be considered harmless products.

    Unlike traditional snus, which contains tobacco, nicotine pouches are generally made with a non-tobacco filler, nicotine, flavourings and other ingredients.

    Are Nicotine Pouches Legal in England?

    Yes. Nicotine pouches are legal for adults in England, but they are now subject to specific restrictions under the Tobacco and Vapes Act 2026.

    Historically, nicotine pouches occupied a relatively lightly regulated area of UK consumer-product law. They did not fall under the Tobacco and Related Products Regulations (TRPR) because they do not contain tobacco, and they were instead covered by general product-safety rules. The government previously noted that there was no statutory minimum age of sale specifically for these products.

    That situation has now changed.

    Nicotine Pouches Cannot Be Sold to Under-18s

    The Tobacco and Vapes Act 2026 establishes an 18+ age-of-sale requirement for nicotine products.

    The legislation makes it an offence to sell a vaping product or nicotine product to anyone under 18. It also introduces an offence for an adult to purchase a vaping or nicotine product on behalf of someone under 18.

    The definition of nicotine products covered by the new framework includes nicotine pouches, along with products such as nicotine gums, strips and pearls.

    This means retailers selling nicotine pouches in England must take appropriate steps to prevent under-18 sales.

    Online Sales Are Also Covered

    The rules are not limited to physical shops.

    The new legislation applies to both in-person and online sales, meaning online retailers selling nicotine products must also comply with the minimum-age requirement.

    Retailers may therefore need appropriate age-verification procedures when selling nicotine pouches online.

    Proxy Purchasing Is Prohibited

    The legislation also addresses situations where an adult purchases nicotine products for a person under 18.

    Under the Act, an adult who buys or attempts to buy a nicotine product on behalf of someone under 18 can commit an offence.

    This is important because simply requiring the purchaser to be an adult does not make a transaction lawful if the product is deliberately being obtained for a minor.

    What About Advertising Nicotine Pouches?

    The 2026 legislation also gives the government stronger powers over the advertising and sponsorship of nicotine products.

    The government says the Act includes measures to ban advertising and sponsorship of vapes and other nicotine products and provides powers to control packaging, branding and displays that could appeal to children.

    The precise implementation of some restrictions will depend on regulations made under the Act.

    For businesses, this means the regulatory environment for nicotine-pouch marketing is becoming considerably stricter.

    Packaging and Product Presentation

    The Tobacco and Vapes Act gives ministers powers to regulate the packaging, appearance and display of nicotine products.

    The government has already begun consultations on how these powers should be implemented.

    This could eventually affect aspects such as:

    • Packaging design
    • Branding
    • Product presentation
    • Retail displays
    • Features that may appeal particularly to children

    Not every proposed restriction is automatically law at the time of consultation, so retailers should distinguish between measures already in force and future regulations.

    Are Nicotine Pouches the Same as Snus?

    No.

    Although both products are placed between the lip and gum, their legal status is different.

    Snus is a tobacco product, whereas conventional nicotine pouches do not contain tobacco. The Tobacco and Vapes Act specifically prohibits the business supply of certain relevant oral tobacco products, while nicotine pouches fall under the separate nicotine-product framework.

    Consumers should therefore avoid treating “nicotine pouch” and “snus” as interchangeable legal categories.

    Can You Use Nicotine Pouches in Public Places?

    Nicotine pouches are different from cigarettes and vaping products because they do not produce smoke or vapour.

    There is therefore no equivalent general rule that makes using a nicotine pouch in every smoke-free location automatically unlawful.

    However, individual businesses, workplaces, transport operators, schools and other premises can establish their own policies. Users should follow the rules of the location they are visiting.

    The Tobacco and Vapes Act also gives ministers powers concerning smoke-free, vape-free and heated-tobacco-free places, but these measures should not be confused with a blanket ban on nicotine-pouch use in public spaces.

    What Does the Law Mean for Retailers?

    For businesses selling nicotine pouches, the regulatory landscape is becoming more demanding.

    Retailers should pay particular attention to:

    • Age verification: Do not sell nicotine pouches to anyone under 18.
    • Online sales: Apply appropriate age controls to internet orders.
    • Proxy purchasing: Do not facilitate purchases intended for under-18s.
    • Marketing: Monitor new restrictions covering advertising and sponsorship.
    • Packaging: Prepare for potential requirements governing appearance and presentation.
    • Product compliance: Ensure products comply with applicable product-safety requirements.
    • Future licensing: The Act provides powers for a mandatory licensing scheme covering tobacco, vaping and nicotine retailers, including online sellers.

    Because some provisions require secondary regulations before they take effect, retailers should monitor official government guidance rather than relying on older information about nicotine-pouch regulation.

    Are Nicotine Pouches Safe?

    Legal does not mean risk-free.

    Nicotine is an addictive substance, and the UK’s Committee on Toxicity has concluded that oral nicotine pouches can deliver pharmacologically active doses of nicotine. The committee specifically warned that these products are not harmless, including for people who are not already accustomed to nicotine.

    People who do not use nicotine should not start using nicotine pouches simply because they are tobacco-free.

    For smokers considering nicotine pouches as an alternative source of nicotine, it is also important to understand that nicotine pouches are distinct from licensed nicotine-replacement medicines and are not automatically equivalent to medically approved smoking-cessation treatments.

    What Has Changed in 2026?

    The biggest development is the transition from a relatively lightly regulated market to a much more comprehensive legal framework.

    Previously, nicotine pouches were outside the main TRPR rules because they contain no tobacco. The government nevertheless identified them as an emerging nicotine category and highlighted the possibility of introducing age restrictions and additional controls.

    The Tobacco and Vapes Act 2026 now provides the statutory framework for stronger regulation.

    4. Follow the manufacturer’s usage instructions.
